These Terms of Use govern the relationship between You, as the user (Agent and in some cases the Client of the Agent) of the Service and Website, and Us during Your use or visitation of our Service and Website, please read carefully to be properly informed, because these Terms:

Please note that these Terms of Use are a legally binding agreement between the Principal and You. Mobility is a service that makes travel accessible for everyone. We provide the Partnerka service for booking and selling tickets for various types of domestic and international transportation: trains, buses, planes, etc. for passengers and luggage, so to start using the Partnerka Service, You must first visit our Website onboarding.mobility.partners and register. We provide Agents with the Partnerka service module, which generates ticket search information, including ticket availability from carriers, flight time, ticket price, etc.

As a Client (Agent’s Client), You can book train, air, and bus tickets through the Partnerka service, which becomes available to the Agent via our Mobility service. The Agent registers on our site and creates a Partnerka module, where You can make ticket bookings.

All payments for the tickets You book are credited to Our bank account, but we do not store or process Your payment data. All transactions are made via Stripe or other payment systems with which We cooperate. We do not directly collect Your payment data. To find out what information is collected during a payment transaction, please review the Agent’s Terms of Use or the Terms of Use of the payment system used to process payments.

Please note that We are not responsible for any content or information posted by the Agent in the Partnerka Service. The Agent is solely responsible for the accuracy, completeness, legality, and relevance of the content.

Before You start using our Service, You must go through the registration process on the Website to create Your User Account.

Your user account provides You with access to the Partnerka Service and functionality that We may establish and maintain from time to time at Our discretion.

During registration, We will ask You, as a company representative, to provide Us with Your personal data and your company’s data by filling out a special registration form. You will complete the creation of Your User Account by confirming your email address, after which You can sign the Commission Agreement, where You will need to provide a little more information about the company you represent.

After registration, You will also have the opportunity to try the demo version of the Partnerka Service, which gives You access to all functionality except the ability to book and pay for tickets for clients. To allow clients to use these features, You must sign the Commission Agreement.

We carefully treat Your data, so we use the minimum information about You and your company to create Your User Account. To learn more about the collection, storage, and transmission of Your personal data, please read our Privacy Policy.

To complete the registration process, We will ask You to agree to our Terms of Use and Privacy Policy. If You do not agree with these Terms of Use and Privacy Policy (or cannot comply with them), You are not entitled to use Our Service.

Once You create a User Account on the Website, We will provide You with access to the functionality of the Partnerka Service and Website, provided that You use these features in a manner permitted and authorized by Us.

Once You have created a User Account and signed the Commission Agreement, the process undergoes Our internal moderation. Only after successfully passing moderation will You be able to complete the account creation process and gain full access to the Partnerka Service. Moderation may take some time, but We strive to complete the process as quickly as possible.

You are fully responsible for all actions related to accessing the Partnerka Service and Website, as well as for the security of your computer systems and password. We are not liable for any losses or damages related to such activities.

You are entitled to a commission for tickets sold to clients using the Partnerka service. The payment of such commissions is governed by the terms outlined in the Commission Agreement.

Payment methods for purchasing tickets

The client transfers payment for purchased tickets to Our Stripe, Liqpay, or other payment systems. We pay Your commission according to the Commission Agreement, based on monthly or quarterly sales reports and the invoice received from You.

We also recommend that you carefully review the terms of use of Stripe and Liqpay.

For the purpose of using our Services, as described in these Terms of Use and other legal documents, from the date of registration of Your User Account, We grant You a non-exclusive, non-transferable, worldwide license for limited use of the Partnerka service and Website. To avoid doubt, the license is granted to You and Your company without the right of transfer to any third party.

You acknowledge and agree that all rights to the Partnerka Service and Website, content published on this Service and Website, including but not limited to functionality, as well as all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement, visual interface, digital downloads, text materials, graphics, logos, and all other elements of the Partnerka Service and Website are and will remain Our exclusive property.

These Terms allow you to use our Service and Website only for a limited purpose.

When using Our Partnerka service, You agree to allow Us to use and display Your organization's logo on Our Website and in other promotional materials, as well as for press releases, presentations, video presentations, and other marketing materials that state that You are Our client/customer for promotional purposes.

Additionally, You may indicate Us as Your counterparty on Your website and or in Your promotional materials and use Our logo for these purposes. However, You agree that any use of Our logo by You must be subject to Our prior written consent.

Your trademarks and all international intellectual property rights to them are Your exclusive property. Our trademarks and all international intellectual property rights to them are Our exclusive property.

You must use the Partnerka service and Website in full compliance with the provisions of these Terms of Use. You may only use the Partnerka service and Website as long as such use is not illegal or prohibited by these Terms of Use. You may not use the Website in any way that could damage, disable, overburden, or impair the Mobility company, Partnerka service, or Website. You may not obtain or attempt to obtain any materials or information through the Website in any way that is not specifically provided for such access.

Please note that We are not a carrier or travel agent and do not directly provide transportation services.

We and our licensors, suppliers, agents, affiliates are not responsible for lost profits, revenue, or data, financial losses, or indirect, special, incidental, punitive, or exemplary damages.

This Website and Partnerka service are provided "as is", with all faults, and We do not make any representations or warranties related to this service or content published on this Website.

You are personally responsible for how You communicate with clients, as well as for the accuracy, completeness, and legality of the texts and information You post in the Partnerka service. We are not responsible for any consequences that may arise as a result of posting this information or Your communication with clients.

We make no representations and provide no warranties regarding the results obtained from using the Partnerka service and Website, specific features of the Partnerka Service and Website, or their reliability, availability, accuracy, or ability to meet Your needs. We do not guarantee that access to the Partnerka service and Website will be uninterrupted or error-free, or that defects in the Partnerka service and Website will be corrected.

Your privacy is important to us. You can learn how we process Your information when You use our service by reading our Privacy Policy. We encourage You to carefully read the Privacy Policy because by using our service, You agree that We may collect, use, and transmit Your information in accordance with this policy.

• You will not use the Partnerka service and Website in a way that disrupts, interferes with, negatively affects, or hinders other users from fully enjoying the Partnerka service and Website, or that damages, disables, overburdens, or impairs the functionality of the Partnerka service and Website.

You agree to indemnify, release, and hold harmless the Principal and its parent companies, subsidiaries, affiliates, licensors, and suppliers, as well as all their officers, directors, employees, and agents from any damages and liabilities (including pre-trial settlements, judgments, fines, and penalties) and expenses (including reasonable attorneys' fees, court costs, and other litigation expenses) arising from any claims or demands made by any third party in connection with Your access to the Site, use of the Partnerka service, violation of these Terms, and in connection with any claims or demands made by third parties due to Your access to the Site or use of the Partnerka service, violation of these Terms, as well as in connection with violations of intellectual property rights or other rights of any individual or business entity.

The Partnerka service is intended only for access and use by adults (not younger than 18 years). By accessing any Partnerka service or using it, You warrant and represent that You are of legal age and have the authority, right, and capacity to enter into this agreement and comply with all provisions of these Terms. If You are a minor, You are prohibited from both accessing and using the Partnerka service.

By using this Partnerka service and Website, You agree that the laws of Ukraine will govern these Terms of Use or any disputes that may arise between Us and You.

All disputes related to these Terms of Use will be resolved through negotiations between Us and You, and We will make every effort to resolve the dispute.

If We are unable to reach an agreement, disputes will be resolved in court.

We reserve the right to amend these Terms of Use. We may notify You of such changes in these Terms of Use by posting a notice on the Website. Updates become legally binding upon posting the updated Terms on the Website.
